REGULAR MEETING OF THE KOOCHICHING COUNTY BOARD OF COMMISSIONERS
Held on Tuesday, January 20, 2004; 11:00 a.m.

2004/01-22 Motion by Lepper, seconded by Adee to approve the agenda with additions and deletions. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-23 Motion by Hanson, seconded by Lepper to approve the minutes of the January 13 special meeting. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-24 Motion by Lepper, seconded by Adee to approve payment of the Highway bills in the amount of $162,307.05, to approve payment of the Auditor bills in the amount of $126,379.19 and to approve payment to Flaherty & Hood, P.A. in the amount of $2,323.10 with payment from the 2004 Legislative Budget. Payment detail on file in the Highway and Auditor Departments. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-25 Motion by Hanson, seconded by Adee to amend Board Motion 2002/04-32 adopting the Commissioner Redistricting Plan designating the election district boundaries:

DISTRICT I
Beginning at the international boundary due north of the western boundary of the Village of Ranier,

2004/01-26 Motion by Hanson, seconded by Lepper to approve Board members’ attendance to the 2004 Minnesota Chamber Session Priorities Event on February 2, 2004 in Bloomington, MN at the request of the local Chamber of Commerce. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-27 Motion by Lepper, seconded by Adee approving a Minnesota Lawful Gambling Premises Permit Renewal sponsored by the Northome VFW Post 3869 for the Country Sampler Restaurant & Saloon effective May 1, 2004 to April 30, 2006. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-28 Motion by Adee, seconded by Hanson that the Koochiching County Board supports South Koochiching-Rainy River School District #363 in its project to develop a series of walking and cross country ski trails in the C.W. Bray School Forest located adjacent to the Northome School Property as a benefit to the students and the general public. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-29 Motion by Lepper, seconded by Hanson adopting the following resolution for membership to the Northern Counties Land Use Coordinating Board:

WHEREAS, Roseau County has applied for membership to the Northern Counties Land Use Coordinating Board (NCLUCB); and

WHEREAS, the Northern Counties Land Use Coordinating Board has voted to recommend and accept the application establishing Roseau County’s membership.

THEREFORE BE IT RESOLVED, that in accordance with the Northern Counties Land Use Coordinating Board Agreement, Koochiching County hereby ratifies Roseau County’s application for membership and agrees to amend the Agreement to include eight counties, namely Cook, Koochiching, Lake, Lake of the Woods, Marshall, Pennington, Roseau and St. Louis.

BE IT FURTHER RESOLVED that Koochiching County Board Chair Wade Pavleck sign the amended Northern Counties Land Use Coordinating Board Agreement on behalf of Koochiching County. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

000 The Board Chair provided the Board the final 2004 appointments and committee listing. (Final changes from draft – Commissioner Lepper to replace Commissioner Pavleck on the Solid Waste Advisory Committee and to replace Commissioner Adee on Kootasca. Board Chair also appointed Commissioner Lepper and Commissioner Chezick to a temporary committee to review Rule 25 Assessment services.)

2004/01-30 Motion by Hanson, seconded by Lepper approving draft bill JH76 to submit to the 2004 Legislative Session for change to the ATV Law exempting Counties having wetlands 50 to 80% or greater from ATV restrictions on wetland types 3, 4, 5 and 8 and unfrozen public waters with further modification to the bill pending additional information from meetings with the Lobbyist and DNR. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

000 The Board directed the Coordinator to set up a telephone conference with the Lobbyist and DNR staff to review the County’s draft bill for changes to the ATV Law.

2004/01-31 Motion by Hanson, seconded by Lepper approving the following expenditures from the 2004 IS Capital Outlay Budget as recommended by the IS Unit: $12,800 to Dell Corp. for purchase of 11 systems; $2,600 to Software House International for purchase of 8 MS Office XP Licenses and $4,200 to Software House International for purchase of 15 Windows XP license and installation CD. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

2004/01-32 Motion by Chezick, seconded by Lepper certifying performance for SAP 36-630-11 with Gladen Construction, Inc. in the amount of $2,638,094.35 as recommended by the Highway Engineer. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.

000 The Board Chair called for public comment at 11:40 a.m. No comment was provided.

2004/01-33 Motion by Adee, seconded by Chezick to adjourn the meeting at 11:40 a.m. Voting yes: Pavleck, Lepper, Adee, Hanson, Chezick. Motion carried.
